Terms and Conditions

These Terms and Conditions (“Terms”) govern the provision of 3D printing, additive manufacturing, design, prototyping, and related services (“Services”) by Additivex3d (“we”, “us”, “our”) to the customer (“you”, “your”).
By placing an order, requesting a quotation, or using our Services, you agree to these Terms.
1. Scope of Services
Additivex3d provides 3D printing, additive manufacturing, rapid prototyping, design assistance, post-processing, and related services as specified in quotations, invoices, or written agreements.
All Services are subject to material availability, machine capacity, and technical feasibility.
2. Quotations and Orders
Quotations are valid for 30 days unless otherwise stated.
Prices are based on the information, files, specifications, quantities, materials, and tolerances provided by the Customer at the time of quotation.
Any changes to specifications after order confirmation may result in revised pricing, timelines, and delivery dates.
An order is deemed accepted when written confirmation is issued or production commences.
3. Customer Responsibilities
The Customer is responsible for the accuracy, completeness, and suitability of all files, drawings, models, dimensions, and specifications supplied.
The Customer warrants that they own or have the legal right to use, reproduce, and manufacture the submitted designs.
The Customer is responsible for ensuring that the intended use of printed parts complies with all applicable laws, regulations, and safety standards.
4. Intellectual Property
All intellectual property rights in Customer-supplied designs remain the property of the Customer or the relevant rights holder.
The Customer grants Additivex3d a limited, non-exclusive licence to use submitted files solely for the purpose of providing the Services.
Unless otherwise agreed in writing, all intellectual property in designs created by Additivex3d remains the property of Additivex3d until full payment is received.
Additivex3d reserves the right to refuse any order that may infringe intellectual property rights or violate applicable laws.
5. Materials, Tolerances, and Variations
3D printing is an additive manufacturing process and may involve inherent variations, including layer lines, surface finish, colour variation, strength, and dimensional tolerances.
Unless expressly stated, parts are produced to standard industry tolerances applicable to the selected process and material.
Samples, renders, or prototypes are indicative only and may not exactly match final production parts.
6. Quality, Inspection, and Acceptance
The Customer must inspect all delivered goods within 7 days of receipt.
Any claims for defects, shortages, or non-conformity must be made in writing within this period.
Additivex3d is not responsible for defects arising from:
Defective or unsuitable Customer-supplied designs
Normal wear and tear
Misuse, modification, or improper application
Our liability is limited, at our discretion, to reprinting, repairing, or refunding the affected portion of the order.
7. Pricing, Payment, and Taxes
Prices are exclusive of GST, shipping, customs duties, and other applicable taxes unless stated otherwise.
Payment terms are 100% in advance unless otherwise agreed in writing.
Late payments may incur interest at 2% per month and recovery costs.
Additivex3d reserves the right to withhold delivery until full payment is received.
8. Cancellations and Refunds
Orders may not be cancelled once production has commenced.
If cancellation is accepted prior to production, the Customer may be charged for work completed, materials ordered, and administrative costs.
Due to the custom nature of 3D printed products, refunds are generally not provided except as required by law.
9. Delivery, Risk, and Title
Delivery dates are estimates only and not guaranteed.
Risk passes to the Customer upon dispatch or collection.
Title to goods remains with Additivex3d until full payment is received.
10. Limitation of Liability & Australian Consumer Law
To the maximum extent permitted by law, Additivex3d excludes all warranties, representations, or conditions not expressly stated in these Terms.
Additivex3d is not liable for indirect, consequential, or economic losses, including loss of profits, revenue, or business.
Additivex3d’s total liability under any order is limited to the amount paid by the Customer for that order.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified.
Where the ACL applies and liability may be limited, Additivex3d’s liability is limited, at its option, to:
Re-supply of the Services; or
Payment of the cost of having the Services supplied again.
11. Prohibited Uses
The Customer must not request the manufacture of items that are illegal, unsafe, or regulated without proper authorisation, including but not limited to:
Weapons or weapon components
Controlled medical devices without approval
Counterfeit or infringing products
Additivex3d reserves the right to refuse or terminate any order at its discretion.
12. Confidentiality
Both parties agree to keep confidential any non-public technical, commercial, or proprietary information exchanged in connection with the Services.
13. Force Majeure
Additivex3d is not liable for delays or failure to perform due to events beyond its reasonable control, including equipment failure, supply shortages, natural disasters, or government actions.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of Victoria, Australia.
15. Amendments
Additivex3d may update these Terms from time to time. The latest version will apply to all new orders.
